Terms of Service

These Terms govern the use of the arkame.app website, the panel and the Arkame agent. By creating an account, starting the trial or subscribing, you agree to them. If you sign up on behalf of a company, you confirm you are authorized to do so.

Written in plain language, to be read. Specific corporate agreements may complement these Terms. The Portuguese version prevails in case of discrepancy.

Arkame is the trade name. The charge shows on your card as ARKAME.APP.

1. The service

Arkame is a BYOS (bring your own storage) backup orchestration service: a web panel and a program, the Arkame agent, that you install on your servers. The agent copies files straight to an S3-compatible bucket that you own, at the provider you choose; the panel schedules, monitors and coordinates restores.

Storage is not part of the service: you contract and pay for it directly with your provider.

2. Account and access

You sign in with a Google account or with a sign-in link sent to your email. Keep access to your email and account secure, and turn on two-step verification. You are responsible for what the people you invite do in your organization, according to the roles you give them.

Registration data must be accurate — including the organization’s country, which sets the billing currency, and the tax details used on invoices.

3. Your bucket, your keys

Backups live in your bucket, and the keys to it stay only on your server. Arkame has no copy of the content or the keys — so it cannot recover data deleted by someone holding your keys, nor data your provider lost.

It is up to you to configure the bucket (versioning; Object Lock with a default retention, if you want ransomware protection; lifecycle rules; key permissions) and to pay the provider. Storage, requests, egress and cold-tier rehydration are billed by them, not by Arkame.

Test your restores from time to time. A backup that was never restored is a hypothesis.

4. Acceptable use

Do not use Arkame for illegal activities or to back up data you have no right to process. Do not try to access other organizations’ data, bypass limits or billing, overload the service or reverse-engineer the panel. Reselling the service is only allowed through the Partner Program.

We may suspend anyone who breaks these rules, giving notice first whenever possible; if other customers’ security is at risk, suspension may be immediate.

5. Free trial

Every new organization gets a 14-day free trial, with no card. If the trial ends without a subscription, scheduled backups stop; restores keep working, and subscribing picks up where it left off.

6. Subscription, renewal and per-server billing

The subscription is monthly and renews automatically every period, on the payment method on file, until you cancel.

We bill per active server: the quantity follows the servers approved in the organization. When you approve or archive a server mid-period, the prorated difference shows up on the next invoice, as a charge or a credit.

Payments are processed by Stripe; the charge shows on your card as ARKAME.APP.

7. Currency and taxes

The currency depends on the organization’s country: organizations in Brazil pay R$ 25 per server per month, in reais; all others pay US$ 5 per server per month, in dollars.

Outside Brazil, local taxes, foreign-exchange costs and card-issuer fees are the customer’s responsibility.

8. Price changes

We may change prices with at least 30 days’ notice by email. The new price applies from the first renewal after that period; if you do not agree, you can cancel before it at no cost.

9. Non-payment and suspension

If a payment fails, the subscription becomes past due, we notify you by email and the processor retries over the following days. After 7 days overdue, the organization is suspended: scheduled backups stop, but restores keep working — an expired card is no reason to deny someone their own backup.

Settling the payment reactivates the organization. If it remains unpaid, we may cancel the subscription, with prior notice by email and the effects described in section 10.

10. Cancellation and what happens next

You can cancel at any time, with no penalty, in the panel under Billing (Stripe’s subscription portal). Cancellation takes effect at the end of the period already paid: everything works until then, and there is no further charge.

When the cancellation takes effect, the account is closed: backup and restore through the panel stop. Account data and the backup catalog (names, paths, sizes and versions of files) are kept for at least 30 days — if you come back within that period, nothing is lost. You can ask for deletion at any time, before or after that period, at contato@arkame.app, and we delete everything from the database within 15 days (our database backups drop it as they expire, in 30 days), except what the law requires us to keep, such as tax records.

Your backup content stays in your bucket, untouched, and you access it directly at your provider, with or without Arkame.

11. Right of withdrawal

Within 7 days of taking out the subscription (the first payment), you may withdraw and get back the full amount paid, as article 49 of Brazil’s Consumer Defense Code guarantees for online purchases. We extend this right to businesses and to customers outside Brazil.

To withdraw, write to contato@arkame.app from the account’s email address. We cancel the subscription and refund the amount to the same payment method.

12. Refunds

Besides withdrawal, we refund in full if you were charged by mistake, if the service did not work as described, or if you ask within 7 days of a renewal you did not want. Outside those cases, periods already started are not refunded pro rata, but we look at each case.

Refunds go back to the same payment method; the time to appear depends on your card issuer.

13. Invoices

For customers in Brazil, we issue an electronic service invoice (NFS-e) for every charge, with the organization’s tax details. Customers outside Brazil receive the invoice and receipt for each charge.

14. Availability and limitation of liability

We work to keep the service up, but we do not guarantee uninterrupted operation: maintenance and network and supplier failures happen. If the panel is down, your bucket and the backups already made are not affected.

Arkame is not liable for losses caused by the configuration of your bucket or keys, by unavailability or failure of your storage provider, by actions of whoever holds your keys, by failures in your environment, or for data that was never copied. To the extent permitted by law, Arkame’s total liability is limited to what you paid in the 12 months before the event. Nothing here removes rights that consumer protection law guarantees to consumers.

15. Personal data

Personal data is handled under the Privacy Policy. For backup metadata (file names and paths, which may contain personal data), you are the controller and Arkame acts as processor, handling it only to provide the service.

16. Changes to these Terms

We may update these Terms. Material changes are announced by email or in the panel with reasonable notice — 30 days for prices. If you do not agree, you can cancel before the change takes effect.

17. Governing law and jurisdiction

These Terms are governed by the laws of Brazil. The courts of Goiânia, State of Goiás, Brazil, have jurisdiction, without prejudice to a consumer’s right to sue in the courts of their own domicile.
